Tru Fuel – Terms & Conditions & Liability Waiver

1. Acceptance of Terms

By purchasing, receiving, or consuming any Tru Fuel products (“Products”), the customer (“You”) acknowledges and agrees to the following Terms & Conditions and Liability Waiver. If You do not agree, do not purchase or consume Tru Fuel products.

2. Product Use

  • Tru Fuel products are formulated as sports nutrition supplements designed to provide energy and hydration support during physical activity.
  • Products are not a substitute for a balanced diet, medical treatment, or professional advice.
  • Products should only be used in accordance with their intended purpose, as indicated on packaging and/or marketing material.

3. Medical Disclaimer

  • Tru Fuel is not a medical organisation and does not provide medical advice.
  • Always consult a qualified healthcare professional before using Tru Fuel products, particularly if You:
    • Have, or suspect You have, any medical condition,
    • Are pregnant or breastfeeding,
    • Are under the age of 18,
    • Take medication that may interact with ingredients contained in Tru Fuel products.
  • Use of Tru Fuel products is entirely at Your own risk.

4. Ingredient & Allergen Information

  • Tru Fuel products are manufactured with natural ingredients. While Tru Fuel makes every reasonable effort to ensure accurate ingredient labeling, cross-contamination is possible.
  • By consuming Tru Fuel products, You accept full responsibility for checking labels, ingredients, and ensuring no allergens pose a risk to Your health.
  • Tru Fuel is not liable for any allergic reactions, intolerances, or sensitivities that may arise.

5. Assumption of Risk

  • Sports, training, and endurance activities inherently carry risk of injury, illness, dehydration, or death.
  • By purchasing or consuming Tru Fuel products, You voluntarily assume all risks associated with their use before, during, or after physical activity.
  • Tru Fuel disclaims any and all liability for injury, illness, or damages that may occur in connection with the use of its products.

6. Limitation of Liability

To the maximum extent permitted by law:

  • Tru Fuel, its founders, employees, agents, and distributors shall not be held liable for any injury, illness, death, damage, loss, cost, or expense (direct, indirect, incidental, consequential, or punitive) arising out of or in connection with the use, misuse, or inability to use Tru Fuel products.
  • In the event liability cannot be excluded by law, Tru Fuel’s total liability shall be limited to the purchase price of the products in question.

7. Indemnification

You agree to indemnify, defend, and hold harmless Tru Fuel, its founders, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with:

  • Your purchase or use of Tru Fuel products,
  • Your breach of these Terms & Conditions,
  • Your negligence, misconduct, or misuse of the products.

8. Returns & Refunds

  • Due to the consumable nature of the products, Tru Fuel cannot accept returns once packaging has been opened.
  • Refunds may be issued at Tru Fuel’s sole discretion in the case of defective, damaged, or incorrectly delivered products.

9. Intellectual Property

All content on Tru Fuel’s website, packaging, and branding (logos, product names, designs, photography, etc.) is the exclusive property of Tru Fuel and may not be used without express written consent.

10. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.

11. Entire Agreement

These Terms & Conditions constitute the entire agreement between You and Tru Fuel relating to the use of the Products, superseding any prior agreements, communications, or understandings.

Waiver of Liability & Release

By purchasing or consuming Tru Fuel products, You expressly acknowledge and agree:

  • I have read and understood the Terms & Conditions above.
  • I voluntarily assume all risks, known and unknown, associated with consuming Tru Fuel products and engaging in physical activity thereafter.
  • I waive, release, and discharge Tru Fuel, its founders, employees, agents, and distributors from any and all liability, claims, demands, or actions that may arise from my purchase, use, or consumption of the products, including but not limited to injury, illness, or death.
  • This waiver applies to myself, my heirs, executors, administrators, and assigns.
